..my application process? Recently I got a job offer but the employer will pay in 1099 instead of W2. I've always worked on W2. I tried to look for the answer but did not get a clear view?

What if I get an RFE for employment proof?
- If my future employer (which is a legal medical software company) can provide my proof of employment in written letter. Will it be okay?

What if I get RFE for submitting tax papers of past year(s)?
- If they see that along with W2, I also worked on 1099, if that going to hurt my application process?

BTW: Is is a good idea to accept an offer with 1099 at all??
Thank you for your answers in advance.

if you have a GC.......every offer that pays well is a good offer.....

but we being in the hanging state...i do not know the consequences of using 1099, sorry..

Yesterday I got this job offer, which I told them that I'll get back with an answer. Then I started reading the differences between the two. After giving a long thought, I decided not to accept this position, so I call and explained my situation to the company. They said tey'll call me back and they did. They decided to hire me as a W2 contractor, not as 1099, keeping the same pay rate.

It's a good news for me. I accepted the offer.

My thoughts were, for this short term position I cannot jeopardize my long term goal. I came a long way and no way I was going to give them the benefit of a doubt for any kind of trouble.

good thinking and congrats for the new job
1099 is not a good idea at this point :)
