If I don't have old W2 !!!!!

I have entered into US on H1B, I worked for my employer for sometime. He paid little bit in cash and didn't send any W2's for the year 2001.
Then I changed employer and getting paid and got W2s for the next years and second employer filed GC. Now it is in 485 stage.

My question is what if I get query on w2 for Yr 2001. Can I pay some tax to IRS even if I don't have W2 for that Year now.
I have W2s for 2002,2003... also I will get one more for this year....

Please respond if you know the soln....

I didn't understand few things in your words....

1) "From the information you have supplied it seems that 2001 will not come into play for greencard because the priority date of your labor was after 2001. "

What is Priority date and how this is related with RFEs ? (Many guys talking abt this priority date, but I am confusing always....could you please explain little bit abt this)

2) "I believe the only way uscis will go back to 2001 is to prove that you had status and if you had a valid h-1 then you will be fine."

I have valid H1B for 2001. Is that fine for showing valid status ?

Priorit date will be th GC labor receipt date. This date will be attached to your case with I-140 approval.

If you applied concurrently and I-140 is not approved then your Priority Date is I-140 receipt date. Once I-140 is approved then the priority date changes to labor receipt date.

Great!! I got a clear idea now, that how it works....Appreciate your valueble message (specially to me)....

I already got RFE on I-140 for W2 for 2003...(I have filed only W2 for 2002 at the time of filing I140&I485)... I have submitted...after 8 months finally got approved I140....within a week they approved EAD and AP.....

Scary point is about W2 for 2001, if at all they asks in future....hope they won't ask by grace of GOD.....

By the time 485...I may get one more W2 for this year.....This might be covers atleast little bit.....

I will contact you if at all I have any problems since you are an accountant...

Entered in US with H1B but not have paystubs and W2 from old

I read the message below and all your replies. Kindly also let me know with full details keeping in mind that if i have entered in US in Aug 2003 but got Social Security in MArch 2004 and employer paid only 2 months tax till Sept 20th 2004 but have issued no pay cheques and payslips but paid cash salary.
Also i cannot go against the old employer as he is related to me.

1. Am i having a valid H1B status?
2. CAn i get any confirmation of my tax paid?
3. Can i pay from my pocket to IRS the remaining month tax as i donot trust my old employee of payment of tax.
4. What are the chances of getting rejected in transfer to new company. and within how mch time period i should have applied for transfer?
5. What is the chance of disallowance if my wife goes out of US and want to come back to US in this time?
6. If some company is ready to file directly greencard then will this non payment in earlier year create problem at the time of interview.?

Please reply or let me know the site from where i can find the solution to all answers.
