If i am eligible to file for I 130,I 485 please help...

Hello Mr Rajiv,
I came back in usa in 2003 on a visitor visa,since then i am living here and my status was expied,now i have married to a us citizen and want to apply for i-130 and I-485 with my birth name as which is different from the one on which i came,so please advise me if i can apply and what are the chances that USCIS will accept my case,Please Help me...

Did you change your name legally? I changed my name via deed poll when I was 22. I filed for AOS using my birth name that matched my birth certificate, but I also included a copy of my deed poll to back up the different name that was on my passport.
