iEAD in spite of RFE

Just wanted to let you guys know that I was able to receive an iEAD, even though it wasn't 60 or 90 days after they received my RFE response. They didn't even mention my RFE.
I scheduled an Infopass for today and they made me fill out another I-765. Took another picture and fingerprint and 20 minutes later I got my iEAD.

I don't know if I was lucky or how it happened, but for all of you with an RFE, if it's been 91 days after your original I-765 ND (or RD?) it really is worth a try to get an iEAD, in spite of that ineligibility clause in your RFE letter.

Remember I gave it a try too? Well it wasn't 90 days after my RN but I was clearly told that I wasn't gonna get anything till 90 days after the RD of the RFE missing info. This again proves how it depends in the DO and the officer that you get.

When are you starting work?
 
Nice one Patty, I worked out with my RFE it should be around 12th July before the 90 days is up with me. Am I correct in thinking its 90 days straight and not 90 working days?

Payala, my employer needs my Social, so I probably won't work before I got that. But I hope it won't be long until I get it.

RunningSwede, no I didn't ask. Because then I would have had to mention my RFE and since she didn't mention it, I thought it would be better to shut up. :D Most likely my RFE is delaying my case. My iEAD is valid for 3 months. I should be fine until then.

Someitguy, yep, finances should look much better now. Hopefully my Social won't take too long... :)

UnionJax, thank God it's 90 days straight! :) On day 91 you should definitely give it a try.
But hopefully you will just get your EAD soon.

Right, you can count 90 days straight. I think it should be 90 days after they received the response though, so you may be looking at July 27. If you are really unlucky you could get an immigration officer who thinks it should be 90 days since last update, in which case you are looking at a week into August. Of course, Patty's case shows that you can be lucky too and get one without regards to the RFE and last update. It is such a lottery! Hopefully you get your EAD long before that, or even better your GC. :D
 
Ah thanks for clearing that up Running Swede and Patty.

Yeah I've really got my fingers crossed for my GC, but the officer was sooo vague. He didn't even take my I-94, So now I have to focus all my energy on getting the IEAD. God knows whats going on with the GC.
 
I don't think it will take that long. They are issuing interview dates really fast these days and the name checks just can't keep up. So many people here didn't get approved yet because of the pending name check. And I've seen a lot who got their Welcome Letters a couple of weeks later.

Well now you have it, u will be happy get to social ASAP!!! I hope they have your A # or prepare for a 45-60 day wait thats what the social in DC said to me the other day. I should have my social number mid next week.

My job is going great and I get paid on the 15th !!! :D :D :D

Congrats again, keep postin... you should post on my new thread on obtaining credit once you get an EAD.... a nice little thread
 
When I got my SSN as a student I only needed to wait a week or 2 for the card in the mail but he gave me the number right away. I think they issue you a number as soon as you submit your application. They didn't mention anything like that? Because you don't really need to show the actual card, you only need the number.

he said that he has to verify my information with USCIS first. Only then he can issue me a number.
Maybe it's a new rule. Wish I already had the number!!

That's weird, the guy at my SSA didn't say anything about my A number. Everyone has their A number as soon as they got their receipt notices for I-485.
He said he will have to verify my information with USCIS and it could take 4 weeks. They will send me my card after they verified it.

Go celebrate on the 15th! First paycheck has to go on a nice dinner! :)

Not sure how to understand your question ;) :D
But funny story, actually: I almost flashed the IO, because the lower buttons of my shirt were really loose. Very embarrassing. She was a very scary and grumpy lady and actually scolded me to button my shirt right! Maybe she felt sorry for me later on.
Or she got so distracted that she forgot to check for RFEs?? :D
I hope she doesn't do interviews...! :eek:
Well I don't recommend flashing the IO in order to achieve anything. :o
