Case.
485 RD/ND 9/01
EAD Extn 11/02.
AOS Pending. CSC.
Received iead at Newark today.
Folks believe me it was tough. Weather wise brutal and the people (INS) with their miniscule knowledge, awful.
First reached Newark office at 6am, there were already 75 people ahead of me. Had to stand in the cold till 8 am. At 8 am INS officer asked us to show our ids and divided the line in groups of 25. (They were letting only 25 people at a time). After the groups were divided he asked us to stand at the entrance of the building (closed entrance, not in cold), wait another hour to go to room 200 on second floor(Inquiry counter).
There showed all the 485 receipts, ead filing receipt(past 90 days) and the officer accepted our (me and wife's) application. Said need to do IBIS check. Wait another hour to get the application and go to floor 13 room 1300. Gave the form at counter 2 and again wait. We were at the counter
around 10.30am. Around 1.30 our names were announced.
Explained the officer that Employment based EAD, AOS pending, need Temp EAD as EAD extension past 90 days.
The officer blankly said why did you file EAD from CA.
My case. employer in CA, residence in NJ for last two years.
All processing till date from CA. 485 also filed from CA.
EAD, EAD extn from CA.
We reasoned but the smart officer said that he cannot give us the cards as he will have to transfer my file from CA and once it is received they will call me for interview. I was like are you kidding......
Transfer a file for an temp EAD. Man morning 4 hour of cold was nothing compared to the cold no and file transfer respose from the officer. He took our EAD cards and said they were issued in error.
Took his name and asked can I speak to the supervisior?
Again our smart officer said you will have to give written notice to speak to the super. I started drafting a letter and my wife went and asked another person on another counter about
the supervisior, Couple of officers listened and said you don't need a request or so to meet the supervisor just go to another room and talk to her. Next room another officer, told need to talk to supervisor....explained our case...
Supervisior arrives in 10-15 minutes explain our case, while talking she made a statement that since yours is not a employment based EAD we have to call for your file.
I immediately corrected her that mine is employment based, this after 1 hour (half hour with super and half hour with smart officer that my co which pays me is in CA, co. based in CA......)
then she was ok let me take a look.
My lawyer had typed and printed all the forms. No question of mistake.
Super. came back after some time and started asking about I-140. I was not having a receipt of I-140. But she was very considerate and said that per rules you should have filed from Vermont as you stay/reside in NJ. We didn't argue with her.
She said she needs to look about my case and will inform us.
She checked our case and said we will issue you an interim EAD.
Then another one and half hour wait was nothing once we got our pictures taken and the officer handed us the Temp EAD's. The EAD's were issued for a year. Guess all the folks on immigrationportal.com know that interim EAD is for 8 months but these qualified oficers gave me for a year. GREAT be my guest I will take for a year. (Probably Newark office is a little more considerate to the trouble they give you before giving
you the actual card).
Anyway folks just fight for your rights. Many a times the officer on the window is unaware of the changing rules and regulation. So talk to the supervisor when in doubt.
Hope this helps other folks.
Thanks.
