I filed concurrently (140/485/765) last January 03, and no RFE has been received yet.
Last week we were notified that our company will be acquired by another company, and the future company will hold their name. The process is expected to be finished by September.
The BCIS site says now that the I-140 will take up to 300 days, which will be beyond the deadline for the acquisition, so don't expect to have it approved by that date.
Have two questions:
1.- If I continue working after the merger, do I have to file a new I-140 with the new company?
2.- In case I'm laid off, could I use the interim EAD to find a new employer/sponsor, without being out of status?
Thanks,
Rich
