I have filed I-130,I-765 for my Immigrant Wife who is in USA with me. Received the NOA for I765/I130 :) (not yet for I-485  :( )

We will soon receive Appt notice for Biometrics.
Her only photo ID is her passport which has her Maiden name, When we filed the I-130, i-765 & her I-485 we used her new Married last name ( mine)

Do we need to 1st get her ID changed to her new married name or will her passport with maiden name & the original marriage liscense work for proper ID at Biometircs appt.?

Please advise

All of my IDs are in my maiden name so I took the marriage certificate with me, along with my passport - this was all the ID that was required for the biometrics appointment.

I asked tht question in another thread and no one answered. Anyway glad to see the answers as I have my fingerprinting appointment tomorrow and I am in a similar situation.

Thanks for the replies 1 more ?

Marriage certificate is legal proof of name change.

On our marriage Cert. It only shows my wifes maiden name, it does not reflect her new married last name, will this be a problem?

Yes, I think that will be a problem (my opinion) because the marriage certificate would have been the basis for your wife to legally use a new last name. Since it's not on the certificate, the paperwork should probably have been filed in her maiden name. Anyone else can comment? Please call USCIS...

Actually, that could be....I don't know.
In New York State, you already change your surname when you get the marriage license (it clearly says "New surname: Groom's surname").
That doesn't change it on your IDs, SSN, but it is still legal proof.
I went to the bank last weekend to add my wife and create a joint bank account and I was able to add her with her new last name, even though she has no ID with that yet. They accepted the marriage certificate.

I know that by law the allowed last name changes (without court approval) are Spouse's last name, combination of both last names, combination of ex-spouse-new spouse. Maybe that will work.

Thank you all for replies, I spoke with a legal rep & she said In CA. the new brides maiden name is still on the Marriage cert. so we would bring that along with her official ID to show she is married with a new last name,
The reason we are concerned is that we filed all of her forms with her new married name but have no legal documentation with her new Married name.

We are going to the Japanese Consulate to change her passport to reflect her new married name , hopefully this will be done before we have our biometrics appt.

Thanks again .
