This is mainly for IBM employees. I am one and I have heard rumours that IBM LC are not getting certified at PBEC (even the old ones from 2001). They are not getting rejected either. Can other IBM employess trash/proove this rumour. If you know somebody from PBEC (from IBM) getting their LC approved, can you please post it here.

HI IBM LC

I am a IBM'er(PWC) too. My LC was filed when I was in PWC in Jan 2002 from NY SWA. Not heard any communication regarding the 45 days letter or Case closed. However I know one of my friend who is an IBM employee recieved his 45 days letter. From what I was told by Fragomen was that they have cases waiting from 2001.
 
I have already rcvd my letter and replied back (me alsp PwC). In fact everyone from my state around my time has gotten their LC cleared (if you believe the tracker here). IBM ppl have not. (I know a few of my fellow travellers). Was wondering is that delebrate or accidental.

Which state did you file from? If you dont mind What is your PD?
 
No 45 DL PD: Jan 2002 - RIR EB2 (Regional)

same case here, KS IBMer -DBEC
PD Jan 2002 (filled by Sprint Transitioned to IBM)
Regional RD: DEC 2002
NO 45 Day letter - no other update yet.

Note: I know 3 people PD BETWEEN JULY - DEC 2002, Transitioned to IBM 6 month after I did and were approved Between May - July 2005. One of these guys got his I-140 approval. There are other 5-6 people PD early 2002, who received 45 DL in April - August 2005 but LC still pending. these are all DBEC.

Dont know what is happening?

Couple of weeks earlier I sent a mail to attorney asking about the status. They dont think delay is anything specific to do with IBM or transition to IBM from different company but they attribute the dealy to huge backlog. They sympathize with our situation but they dont think they can do anything to make things better. When I asked them about it, they suggested I go to my congressman for lobbying... :confused:
 
The only way to descredit this rumour is to post if you know of any IBM LC approved from PBEC (even DBEC helps, but DBEC and PBEC have different rules). Please post details such as what was the acquired company name, year, state, rir or not AND EB-2 OR eb-3.

Did you try to send email to h1b7yr and see whats going on??

i don't mean to scare you though.... you got to more serious , i think..., as u have a old PD and a LOT of cases with that pd from VA have been cleared...
 
ya I got the 7th yr screen shot, it is in RIR stage (when they use to tell). I know few IBM ppl as early as me stuck, so was wondering is there a pattern. I yet do not know any1 from IBM and in PBEC having rcvd approval. So my concern.

Almost similar case here,
I was (PwC) IBM, LC filled in Jun 2002 just before PwC got acquired. My Blue Pg Mgr told me that IBM will not continue PwC's LC as it is was not certified then . He mentioned people who's LC got approved in PwC were allowed to continue with GC process in IBM. ... Looking at your case, I think they duped me.
Anyways......
I quit IBM last year, before quitting, I had my LC filled with some Desi firm and was about to get certified (May 04 PD) when BEC happened. A friend was early May 04 got certified from the same company, I was the unlucky culprit who was bitten by BEC.Alas!!!!!

There is something definitely fishy going on with IBM LCs in BECs.
Many of us have PDs in 2002-2003, but only two have received 45 day letters, and when these two guys contacted Fragomen, they say DOL has not given instructions(to IBM) on how to proceed with the cases in BECs. IBM is the most paranoid and laziest company, it hardly cares about its employees and on top of that we have this lousy DOL and USCIS.
Frankly, who ever has not entered 6th yr, bail out.

Hi kgp - I came to know through Fragomen website. Fragomen does not generall contact employee for LC communication. They contact the manager to confirm if they still want to continue the application for the employee. It depends on each individual manager whether to communicate or not to their employees. In my case I sent a note to Fragomen asking for clarification. I got a email telling that the person who handles 45 days letter response has been out of office and once the person returns they will contact my manager and will respond to the BEC in a "timely manner" - Its a joke after waiting years together for this letter when it comes there is a further delay from the attorney's side to communicate to the manager and respond to BEC. Well I am planning to send another email monday to check on the staus

Singam, I know a colleague of mine has received 45days letter. His PD date date was 2 days earlier to mine but he received his 45 days letter early February. I am not sure if its IBM... It looks its more to do with the BEC mess

Nobody has told me yet that have they or their's friend LC for IBM (pWc) has been approved by PBEC. The attorney claim that they have heard some approval from DBEC but any from PBEC??

Well I did some enquiries on my own. Many PwC/IBM people have gottn there labor. The funny thing is (I guess it's a batch process), almost high number of labor were applied at the same date, the approval of that has been spread over 6 months and counting!!
