Hello.. Im a LPR and have applied for my Citizenship. My husband is under removal proceeding since 2009 because of the overstaying. His Master hearing is coming up this month and the attorney we had is asking us way too much money to continue the case, thats why im here... We have applied for his I130 and its still pending. I wanted to know, what do we ask the judge at his hearing. Is he going to postpone a decision because its still pending? Help!
Also he has a I130 approved from his brother which was filed back in 2001 and was approved in 2009. NVC has no record of his case as of yesterday and his priority date on that has passed too. So he has a visa waiting for him? do we use that in court as well?
