I94 issue and passport stamping

Hi,

I went to Canada during the thanks giving of 2004. I did submit I94 because I left USA. While coming back I asked the immigration officer for new I94 but he didn't give a new I94 to me. He said that my I797 already have a I94 which I didn't submit so he is not going to give me extra I94.I know he was wrong but you can't argue much with these officers. Now I do have that I94 which comes with approved I797 but that doesn't have my entry date in USA. My second step I140 is approved and waiting for October. Here are my concerns.

(1) Is there going to be any problem for getting my GC because of this I94 issue? After the third step is approved I will need to go for your passport stamping at that time do they ask for I94? If they ask me to go outside of USA to get new I94 then at that time I won't have any visa or advance parole left to travel out of USA. I have a valid advance parole and I rather travel out of USA just now.

(2) What do people generally do who have just lost their I94 by mistake in USA? Do they go out of country to get a new one? Or they can just get it from local BCICS office?

Don't worry about,

Thore would be absolutly no issue for stamping. they don't care all they want you not to keep ur old doc once ur case is closed, it mean someone else may use it, thats why they ask, even many office they don't even ask. so don't worry about.


If you still have concerns, I-94 can be issued at local officer too, They do have ur records, u may get it.
