I came to us on 23-Mar-03, along with my wife.

First H1B expired on 15-May-05
Extension approved (received approval on 10-Apr-05) until 15-May-08

My wife's I-94 expired on 15-May-05. When my extension was approved(10-Apr-05), I did receive new I-94 with I-797, but my wife's I-797(case type: I539) did not have any such attachment. Now I am changing my job(transfer of H1B) and would be going to Canada for multiple entry.
do I need to do anything to get new I-94 for my wife, while transferring my H1?
do I need to do anything to get new I-94 for my wife, before going to Canada?

Appreciate your help.

Why your wife did not receive I-94 along with I-797? She should get one otherwise she is out of status since her last I-94 expiration. Contact lawyer immediately.

I94 for dependent..Please help

Thanks dsugandhi,

I was just checking the approval notice for me and my wife..

my notice is I-797A (with I-94), whereas my wife's notice is I-797C (without I-94)..I am guessing that my wife's I-797A might be with the lawyer..I am already in the process of calling him.

Let me know, you know the difference between I-797A and I-797C..

Hi,

you only got I-797C for your wife without -94 because this is only a receipt notice.

I also have a receipt notice I-797C with my case number. They will send seperate approval notice with attached I-94 in the bottom as soon as they reach my case. BTW, H4 extensions are pending between 60 and 90 days....

So, visit uscis.gov and under case status service online punch in your wife case number and you will see what the message is. If you want you can create an account for your wife's case and receive e-mail notification as soon as the case is approved.
hope this helps

Good luck
