I94/ap?

When I entered last time in AP, my I94 was given with a validity till expiry of AP. I have applied for AP renewal now and when I travel with it(after approval), my current I94 would have already expired.

I know, I have to turn in the I94 when I leave the US and by then it would have already expired. Does this cause any confusion?

Any experience on this? thanks

No confusion what so ever!

Most of the people who travel on AP the 2nd time, are in the same boat as you are in.

This is not an issue.

No problem as long as you have an I94. The airline doesn't check for expiry, and when it is entered in the computers, it will show you are an adjustee and there is no restriction upon your duration of stay.

Good luck and have a safe trip.

Lack of I-94 (with valid AP)does not matter per Local INS

Surrendering expired I-94 should not be an issue, if you have a valid AP. Upon reentry, you will be given a new I-94. Even if it expires later on, should not be a problem with an unadjudicated i-485.

When i re-entered last time using AP, officer at POE did not stamp AP or filled-in I-94, but took a look and sent me thru.

Later on, asked local INS officer if that is a problem. They said as long as AP is validm, it is not as issue, contrary to most folks opinions on this forum.

And, i got my AP renewed with the same officer. Should not be an issue, as i took 2 attorney's opinions as well. They were not concerned at all. Not issuing a stamped I-94 is their fault even after we showed them. Since, i have the airline ticket/borading pass, that can substantiate my entry time/date, they re-assured me of it being a non-issue.

Thanks
