My current I797 expires on Sep05'th of 2006. I wanted to apply an extension with a start date of Jul24'th of 2006. I'm working with the same company since day one of my first I797 and still working with the same for my extension as well.
But, my attorney says I couldn't apply with start date earlier than my current I797's expire date. Has anyone encountered this scenario, is it really impossible to do this.
The reason for the start date being earlier is: I have my spouse going for an interview; for which I don't want to send the old I797 and get a visa with an expiry date of Sept05'th as my I797 expires on this day.
Any help would be greately appreciated.
