I797 B with valid VISA

Hi all,

I have valid visa/I94 with employer A till sept2010.
I was laid off in Jan2009.Employer A said he revoked my H1B.
I applied H1 transfer to company B in feb09.
the trasnfer was denied in july2009 .

My lawyer reapplied for H1 with company B in Aug2009.
got approved in sept2009 with out I94(i mean i got I 797B without I94).

AS per lawyer I can go to canada and comeback with New H1 and OLD Visa.

any one has same experience before and How can i convince CBP office about my out of status time..

any help appreciated.

Hi ,

According to my experience , VISA is a travel document ( H1b-eligible to travel for the purpose of Work ), you can use the same visa stamping for different I-797 approvals. But you have to make sure the new I-94 is given for the current I-797 date , not for the old I-797 . You have to keep both copies at the port of entry .
