I751 question

Guys I need help with this issue. I have filed I751 in July 2008. We got married in November of 2005. My marriage is going down hill. I am afraid it is not going to last much longer. What will happened if we get separated or divorced before I receive the card ? :confused:

My time line is :
Temporary GC expires: 10/02/2008
Filed ( Vermont) : 07/03/2008
Check cashed : 07/06/2008
Notice1 : 07/07/2008
NOtice2 : 07/25/2008
Biometrics: 08/13/2008
LUD : 08/14/2008

To be honest I would not worry about it right now, since most of those cases are approved without an interview. If it does come to an interview, then maybe you should get an attorney. But just relax for now and see how it goes.
 
Even if you divorce before the approval of your 10 year card, and in the event you are called for interview, you can syill go by yourself and explain the situation. As long as the marriage was bona fide but ended for unforeseen reasons, you will still get approved.
 
Make a search...is not that bad...just get enough evidence before, during and now/after.
If you divorce before the 10 yr gc gets approved (looking that you are in VSC...ouff), then you must refile again your I-751 alone with the divorce waiver. If you get divorce after get approved then you are okay.

You can check out with a lawyer to see your alternatives, but there are alternatives. In any case...is not that easy to get divorce if that is your final statement. Normally you get separated or you can make things work back and forth.

If you get called for an interview (which still can happen not because of you but it's mostly a random issue) then as long you are in good terms with your spouse even you are in divorce proceedings you two should/can go. If your spouse does not want to go, YOU go and see what they tell you. But you just file your joint I-751 so I wouldn't worry right now until you two are sure that separation is your best term.

Many people think that things are bad...and from saying that to really take actions takes way more time.

So does it mean that i don't need to notify immigration about our separation?
I wish this wasn't happening but the way things are right now is really not good. I've been am very unhappy and depressed for past year. It's hard to be here without my family and go trough situation like this and than there is also this Green Card I have to worry about. I have entered the marriage in good faith and never even thought that it would end up like this.
