I am finally putting together the paperwork to file my and my wife's I-485. I would appreciate if somebody can answer these questions:
1. My parents are US citizens. Does that mean that I will get a greencard sooner ? I read somewhere that if your parents are US citizens then you don't have to wait for visa numbers to be available. Will this apply to my wife too?
2. In 98 I filed to convert from F1(EAD) to H1 - that was the 1st year that the H1 quota got exhausted, so I was out of status for 3.5 months. My lawyer told me that it was OK to work through that period because I had filed for H1 before expiry of my EAD. Later I learnt that working is not allowed during the period you are out of status. Does this mean that I cannot file an adjustment of status or based upon the fact that my parents are US citizens, I can file and my adjustment of status will be approved.
