Hi,
My I485(based on marriage to a US citizen) was pending when I decided to get divorced last year. She was a control freak and always blackmailed me since I was dependent on her to stay in the US. I went through that pain for a long time. She even borrowed a huge amount of debt from the bank on my name and used that all without even mentioning to me. Which I later ended up paying to the bank with my one whole year's worth savings. It was her behavior during my I485 interview which made the immigration officer suspecious and asked for more evidance. I finally asked my employer to sponsor me which they did. Later I went back to my home country, got my new H1B visa stamped and came back to the US. Meanwhile I filed the divore and got that finalized. After coming back I sent the request to the USCIS(both local Atlanta and Texas Service center) to withdraw my pending I485 alongwith the copies of all the notices from USCIS regarding my I485 a couple of months ago. I kept checking the online status which never changed. So I made an infopass appointment and went to the local field office. The IS I spoke with was very rude as expected. She told me that the status in the system has not changed yet. I asked her what is the current status which she told me is "waiting for name check". She asked me to fill out an inquiry form and attach the request and all the documents with that, which she would send to the I485 section. Luckily I had another original notarized request lettter with me. So I filled out the form and attached the request letter with copies of all the notices(except the first receipt notice which I don't have) regarding my I485, copy of my H1B approval, copy of my new H1B visa and a copy of marriage dissolution court order. Now my questions are:
1 - How long it normally takes for the withdrawal change to be posted in the USCIS system after sending the request?
2 - Who is going to make the status change, the local Atlanta office or the Texas service center?
3 - Should I keep sending them requests until my status has changed?
4 - Someone told me to withdraw the parent I130(I am not sure about the application number) as well which was filed by my ex. But since I am not on good terms with her so I don't want to ask her to do anything for me. What should I do about that?
5 - I want to get married again and bring my spouse to the US on an H4. Is it possible to do that without the status change posted in the system or I will have to wait for the change? And could there be any issues to get an H4 due to my status change?
6 - Is there a possiblity that my case may get approved even though I sent the withdrawal request(I don't want this to happen since I don't want to deal with my ex anymore)
7 - I have moved to california. Should I request for the I485 to be transferred to california from Atlanta?(I am afraid it will waste more time)
8 - Once the change is made, would that be reflected in the online status check?
9 - Can my ex do anything to harm me legally(she keeps threatening me how she will do all kinds of crazy things against me)
Any help would be highly appreciated.
