I485 to CP switch problem

Hi,

I have my I485 pending with the INS. Done fingerprinting,
AP/EAD both approved. I am still in H1 status and haven't
used the AP or EAD. I was contemplating switching
to Consular processing.

I heard from someone that having an EAD can present
problems if I switch to consular processing.

Can someone throw light on this?

AOS to CP

gan2003,

You need to file I-824(Application for Action on an Approved Application) to change the GC course from AOS (I-485) to CP. If the consulate in your home country accepts AC-140(Attorney Certified), you can move your case faster. You will need the services of an Attorney for AC-140 route. You can also take the classic CP route by filing I-824 yourself.
