I am new here since I've always found most of the answers to my questions here on your site, however we're going thru a very tough situation, hence why I registered.
My data is as follows:
PD: 04/23/01
I140 : Approved on 2/10/06
I485 : Filed on 03/30/06
FP: Done on 8/20/06
RFE for I485: 8/11/06
2nd RFE for I485: 11/24/06
The first RFE received on 8/2006, in other words revisited entirely the already approved I140, requesting all documentation from the petitioner and ourselves. However this time DHS requested IRS certified taxes from our sponsor, situation that we were able to achieve. Then our attorney submitted all documentation requested to the officer reviewing the case and filed as received on 10/27/06, not missing a single piece of the request and requesting that the adjustment be granted.
However on 11/24/06 I found on USCIS site that a second RFE was mailed to us. I haven't received yet. We pledged to the 245i law, as a labor petition. USCIS asked to submit any of my W2's again and to explain why, if so, I was not working for the petitioner. It was explained that we just received our EAD as 8/06.
Our attorney, by the way one of the best in Southern California, said that there was nothing to worry abou when we received our first RFE.
My wife and myself are desperated. I have a very good job, my kids, both born here in USA have a good life, however this situation is killing us. Please help us with any comment.
