I485 ref emergency help!!!

My wife got a I-485 ref today. The INS ask her file I-485 supplement A with $1000 fine for "without lawful immigration status or have worked in the US without INS authorization for a consecutive period of more than 180 days."

She came to US as my F-2 and then F-1->OPT->H-1. We are confused about this ref. The only thing we are not sure is that she worked catering (preparing food and other stuff) inside campus. We thought F-1 can work legal inside campus.

Does anybody know if this kind of on campus work need INS authorization? Many thanks!

yes, she could and she must have informed the school's International education office about it etc.

You or your laywer just needs to collect all necessary documents and corresponding dates, write a letter explaining everything and you should be fine.

If you can show that none of the work was authorised you will not need to file supplement A or $1000

I didn't include any tax return forms but I did include all document to prove she is legal stay and work here: I-20, H-1 etc.

re:

i am trying to find out how they came to know that she worked on F1. was it because of some documentation u provided ?. if thats the case u will need to review that before responding to the RFE. ur respnse should not be contradictory to the original documentation provided.

That's why you always tell the truth, it's easier to remember.
