I have a question rgd how important is the work location for I485 application.
My AEC was filed in CA in 2001. I moved outside CA in 2003. My AEC got approved in 2004 and I filed for I140+I485 concurrently in March 2004. My I140 got approved in Feb of this year and I485 is pending name check clearance from FBI(yes, I'm one of those-.
Now I have been at the very same job through out, I just work remotely since 2003.
Before I moved out of CA I asked how it would effect my application and was told I had to move back to work from CA once I485 gets approved(this was in 2003). I pinged my lawyers office once again yesterday asking if I do need to do that. Now I'm told that I need to come back before my I485 approval and be on the location till a few months after I485 approval.I can't use portability to change work location because I was not there when it was filed? (I was never there)
How true is that? How does my Work location effect my I485 approval? I was not in CA anyways while filing my I140/I485. All my applications had my outside CA address?
I am very confused on how it works. Can anyone throw some light on the situation
Do I have to move back?
