Notice of Intent to Deny is issued when they want to deny the case unless you submit and prove what they are asking for. whereas RFE means request for evidence that they want to take a look at before making any decision.
btw why did u get notice of intent to deny? what does the notice say? explain clearly

It said
Persuant to 8CFR 245.1(b)(9) and (10), provide evidence of your immigration status for the following periods : Feb xx, 2000 to Aug xx, 2001.
My attorney missed the previous evidence of prior to filing I140/485.

Hi freewill
Ur case looks straightforward. I have seen in many cases in this forum, that USCIS asking for proof of status for some periods. Don't worry, submit whatever, they are asking for and you will be approved soon.

There are different ways to prove that with some combinations of following documents:
1. copy of I-94 for that period (or entry stamp on passport).
2. I-129 for that period.
3. pay stubs for that period.
4. tax returns for that period.
5. employer's letter confirming that he/she was employed in that period.
6. visa stamp valid for that period.
It has nothing to do with I140.
It looks like we should have had to send all evidence documents to show legal status since came to the USA, not just after getting H1B.

Its becaz of I-140, your I-485 is intend to denied or else some other reason..

I think we can submit I-94 and Passport docs.....If I don't have paystubs and w2 for that period I think it is OK....
What do you say Pralay....
But just I-94 cannot indicate you were employed for that period. If can get a letter from employer specifying that you were employed in that period, that whould be good. If you don't have yourt tax return for that period, you can request transcript from IRS. Also your H1 aproval for that period (I-129).

Can you please share your expe. or comment about how long it will take to get the decision after respond to NOID?

I485 NOID 10/14, Resp. 10/28, AD 11/12/2004
