Hi! My husband, a PT, had our I485s filed in 6/04, and since 11/05 we are being told by CIS that it is in FBI name check & securty check phase. Last week our lawyer tells us over the phone that "by mistake, the application may have been submitted under Schedule C instead of Schedule A (special Interest) and it might take another 2-4 years to get green card"!!!!
But if our 485s are in FBI name & security check phase, shouldn't they be in the correct category (schedule A) because if they had been in schedule C, then they should not be at this stage. Right?
We think the lawyer made the mistake, if there is a mistake. We have written to the Director of USCIS to get some clarification. We also wrote to our Senators to get some help. What else can we do? Can we sue our lawyer?
