I485 for minor. Passport required?

Got married and now getting to ready to start I485 and I130. My question is this: My original passport got lost and I had to apply for a new one. My child was in my old passport but not in the new one anymore. Does a minor (under 10, I have Birth Certificate to proof) need a passport for I485? Embassy is being difficult about issuing a passport for a minor living outside of home country so if not needed I rather not fight them.
 
Who is filing for who? Your USC spouse is filing for you and your child?

Some kind of ID is needed, along with proof of legal entry (in particular, the I-94).

Do you have a copy of the old passport and/or visa that was used to enter? Did he enter legally at the same time as you?
 
USC spouse filing for both of us. Yes, I do have I-94 for both of us but have no copy of old passport in which we were both. We both entered at the same time. Thanks
