Hi Guys,

I need help here. I was working with a X company from 1999 to 2003.
During my employment they have filled my GC. My GC status

Priority Date : June 2001
I140 approval date: Sep 2004

I have left X employer in 2003 after filling my I140. But they got my I140 approval. After left X employer i went back to India. Now i came to USA.
Planning to join with X employer again.

1. Is my case still valid to file I485?
2. I hear that labour approval is not valid after 180 days. Is this applicable to my case? Because already my I140 got approved.

Based on this only i am planning to go back to my pervious employer.
Please some one help me.
 
Yes absolutely. One thing many folks new to US immigration tend to forget is that GC is for "future" employment. You dont really have to be working for your GC sponsoring employer until you get the GC.

SO yes, your application process so far is still valid to be taken to next step of I-485 filing if your employer is still willing to sponser and hire you after your green card is approved. Between now and your green card approval you can be working anywhere as long as your GC sponsoring employer maintains the position as identified in your labor certication and is ready to offer you.

Does that help? There is no 180 day rule that is in effect at this time.

If join with my previous employer then only they will file my I485. Look like that may take some time to join.
the problem i see hear is validity of labour approval for 180 days is effective from July 16th. Is this affect my case if i want to file I1485 after July 16th.
 
Where did you hear about this 180 day rule? I do know there was a proposal that one should file 140 within 180 days but I am not even sure that ever went into effect.

Nevertheless, in your case it does not apply since your 140 is already approved. There is no time limit between 140 approval and 485 filing but you should join them as soon as possible since the dates will retrogress back in a few months.

Here's my situation.
Can I marry someone who's not a green card holder or a citizen and file for green card for her? I have a proposal from an F1 who's in the US and would like to clarify this issue before I go ahead with the marriage.

Will I be able to file for her and will she receive GC at the same time I do?
Here's my status :

I'm on I-485 Pending status now. Working on EAD and been here in the US for 9 years.

My priority date is Nov 2002 filed with Nebraska Service Center. Based on the case status on USCIS website, even cases way past nov 2002 have been approved. On inquiry with USCIS I was told my case is stuck in the FBI background check and has not been cleared yet.

Someone please help!
 
I am not sure about this one. I know if she was on H1 or H4 you could since that is a dual intent visa. F1 is strictly student and one is supposed to return to home country after studies.

I think it is still possible but do not want to say I am certain.. But please check with a qualified attorney. And you should hurry up as you do want to get married and file her AOS before your GC comes thru.
