This is for a friend of mine. She has her I140 approved. But currently she is India and will not be able to return before August 17th to file for her and her child. Her child has to stay in India till December due to medical treatment.
1. What is the time limit to file I485 after having I-140 approved?
2. What is required before filing I485?
3. Can she do the medical test in India for her child and her and get it to file along?
4. Or can she file for herself and her child without her child currently being in the US and prove to the immigration that the child is going through treatment till December and then only she can arrive here.
Please, help in answering the question and your immediate answers would really help her in making her decision. Since, I see that the last date for filing is August 17th.
