I485 filed- Lay off- H1 cancellation issue

Hi,

My I485 was filed last month and I may be laid off next month. As a company policy, my company would inform the INS about the lay off and cancel the H-1. Earlier I have posted a discussion about a similar issue and I was advised that it is safe if INS is not informed. I want to pursue our manangement not to inform INS about the layoff and H-1 cancellation.

1) Should the management legally inform INS that a person is laid off?
2) What are the repurcussions to the company if the company does not inform INS?

I want to be able to answer the above issues before I go and talk to them.

Any insights into the above issues will be highly appreciated. Pl let me know if there are any web links available that I can browse reg this issue.

The H1 employers don\'t have to inform the INS of the layoff. But If the INS is careful enough they are certainly able to find out if you are on status. Your SSN and your W-2 tax records will show everything to them.
