I485 approved after I140 RFE

Hi Folks,
      Hope this info would help all the people who are eagerly waiting to hear about I 485 based on RFE for I140 redo(Company merger/Name change)
      Here are my details:
      
    Category: EB-3
      PD: 2/96
      RD: 4/99
      ND: 5/99
      EAC: 99 166 XXXXX
      RFE: July 31, 2000(I140, last 3 years W-2 and tax return,
                   Emp Letter for me and Medical Examination for my wife)
      RFE Sent: Aug 15, 2000(Exp Mail Tracking Info)
      RFE Message Update: Aug 18, 2000
      Approved On: August 31, 2000
      Location: NJ
      Company: Other than RAPIDIGM, MASTECH etc.
      
          I was taken by pleasant surprise to find the VSC automated message changed to "Your case has been approved"(both for me and my wife)yesterday evening. RFE processing took exactly took 14 days(min time). The check I sent for I140 redo was cleared on Aug 25(exactly after a week) and approval was over in another week. I was just predicting that my case might get approved on Aug 31(based on another case in this forum for which RFE took exactly 14 days).
          It has been a roller coaster ride all along and looking back I don\'t know whether I have courage to be in such a situation in future. Any way I am relieved and wish all the folks waiting the best of luck and speedy approval from VSC. I am waiting to go to the local INS office to get the passport stamped.

Hi, about "I140 redo", did you summit an amended I-140 along
with your RFE response (that\'s why you mentioned your check
for I140 redo was cleared on 8/25/00), or you already had
an approved amended I-140 when you got your RFE and so you
just sent the new I-140 approval as part of your RFE response?

If in the former case, did your newly summited amended I-140
get approved in two weeks in the same timeframe of your RFE
processing so that your 485 was finally approved? or, you
just summited an amended I-140 application, and this evidence
satisfied the officer (without waiting for the amended I140
to get approved)?

Hi,
    I filed the amended(or new) I140 in response to the RFE. I did not file it before the RFE. Thank God, still it took the min time. Hope I answered your question.

How much time did your i-140 redo take???????.
Did you have to sign the I-140 papers ?? or in other words Is the redo-I140 same as the original I-140 where we have to sign the application and submit a fee to INS?

Congrats. You are really very lucky to get your 485 approved so fast. I got the exact same RFE (to redo 140 due to company merge)on June 19th,2000. My lawyer replied back on July 19th,2000. INS received in on July 25th,2000 (though the message never changed). My lawyer received the redo I-140 approval notice on Aug 25th,2000. I am still waiting for my 485 to get approved. I have no idea why it is taking so much time, because RFE requirement has been fulfilled. I hope I get it soon.

What salary figure did you (your lawyer) put into this ammended I140:

You see: INS already knows my current salary from my previous RFE response but my original Labor certification (which I am not asked to refile yet ) contains the old salary, which is 25% or so lower.

I\'m EB3 and I received the second RFE asking for new I140.
ND 05/11/99, FP 03/00, 1st RFE 07/29/00, 2nd RFE 08/06/00

As for as filing of I140 is concerned it\'s like brand new(all the employer letter such as support letter etc. should be enclosed) and both you and your Company Representative have to sign the document. It took 14 days for both the I140 to clear and I485 approval.
     Regarding the salary I have put my current salary which might be 30% more than the LC time.

Can you tell me why did they ask your to file new I140? Did your company change its name or merged? As per to phone message, I am getting 2nd RFE. I won\'t know until firday. My company changed its name. I am afraid it is regarding to file new 140.

My company was bought out in a \'successor-of-interest\'
manner after I filed the I485. Then I was unlucky to get the 1st RFE asking me for w2, paystabs, etc.

Hi PainRelieved,

Is there any time limit to reply to RFE..did INS mentioned anything about this in your RFE ? INS mailed the RFE regarding my case on 09/08/2000 and till now i havn\'t received it nor lawyer received it..When i talked to an IIO, she told me that it was mailed on 09/08/2000 to my home address..

    Any help or ideas would be greately appriciated..
