wow 1stly this site is good. did not know that it has all the bells and whistles....u can see im a 1st timer here.

ok now to my issue, I had filed my I140 June 14th 2002 and I fall under the EB2 category, and looks like my priority dates have gone way way past my dates. No news as yet. My lawyer called the VSC and the INS officer told him that my file is sitting in a "pending shelf" When asked what this means, he murmurred "hmmm no idea why it is sitting here". I shall see to it it is taken care of....now we called again next week and another officer says the same thing and this time he said that he will send it to his supervisor who in turn will hand it over to the case officer....all this was before June 1st when we had access to the VSC....Now its worse, the person who picks up the phone just relays the info that we see on the online system...duh I can see that...The online system increased the # of days now to 360 days....well we are way past that too and I wonder what they wld. say now....I need some help here....someone please tell me if I need to refile or just be patient and wait when the VSC will be so kind enough in giving me some info/results/anything

same boat ask lawyer to call up daily till an officer is assigned

i spoke to my attorney and they told me that upon contacting the BCIS though my case has been assigned to an officer on Apr 22 2003 for my RD being 05/31/2002. yes 2002. the file has been taken out only last week. so i should be hearing about it by this week. Also my attorney has started a process which they call "Liason" (one person my my attorney's office talking to one person from BCIS specifically about my case on an alternate day basis . Also the IIO has sent an e-mail to the officer to get the status of my case whose info. is available with my attorney.
I am currently under the thought BETTER LATE THAN NEVER AS I HEAR A LOT OF rejections these days for such long pending cases. (not to dishearten anyone). BTW an RFE was issued in my case due to my employer changing the company name after he bought over another company. the response to the RFE was recd. by INS on 19 oct 2002. I filed for my I-485 on the basis of my earlier I-140 approval RD 11/01/2002. Though EAD/AP and FP has not yet been approved for me , My spouse has recd. all the above three. 3 months ago though my spouse has been on H4 thru out our tenure. However I did walk into the chicago local BCIS office and obtained my interim EAD. I am currently working on my H1 itself (same employer thruout no job change).Once again BETTER LATE THAN NEVER .BETTER LATE THAN NEVER .

thx for the reply. i do not think my lawyers will do anything. i will have to follow up with them to follow up with BCIS that is a monmouth task....

lemme see what i can do.....thx for the reply. Only ? to you is did they tell u the same thing "pending shelf" ....i do not understand what that is.....
which service center do u fall under - NSC??

btw nice name....ideal for this kind of forum - waqt waqtkibaat...lekin waqt waqt ki baat bol bol kar hum to saalo saal ke liye nahi rukh sakte na!! :p

Yes I am with NSC. Also I think that my case was in the pending shelf of the officer assigned on Apr 22. lekin thru my lawyer purzaa hilane ke baad the CSR/IIO has sent and e-mail to the officer and my file has been pulled up once again and the feedback is that I should have a written decision by 2-3 weeks . this is the end of my 2 weeks. so dekhte hain kya scene hai.
Also you can call up the INS 1-800 number and select option 5 from one of the sub menus not option 1 that relays the online message and talk to the CSR they can send an electronic inquiry to th officer regd. your case and you will get a reply in the mail in 3 weeks time regd. ur case. It will not be the online message but the status. It is better to do it thru ur lawyer but if you feel otherwise You can call up but make sure that u tell the officer the foll. sentence. 'Though I understand that I am not the beneficiary of my I140 application I am anxious 'cos it is more than a year after filing and I just wanted to make sure that my file is not lost or there is something obvious that is missing' that is the reason for my call.

waise main aapke vicharon se poori tarah sehmat hoon regd. the saalon saal wait. lekin waqt se pehle aur kismat se zyaada na kise ko kuch mila hai na milega.
My spouse who is on H4 and always has been has already got her EAD/AP/FP all done and clear a long time ago (5 months). that made me feel more that sach to yeh hai ki 'Waqt Waqt hi ki baat' hai.

P.S I am not an attorney and this is just my feedback.
