I140 time when applicant is in india ?

Hello.

How long does it take for I140 stage to be processed for future employment GC, if applicant is residing in india (bombay consulate) at the time of the application ?

Does anybody have link to tracker ?
 
Where you are residing has no impact on the processing of the I-140 petition, since this is still a company's petition and not yours so where you reside is irrelevant. The processing time is the same. Depending on which Service Center it is filed with, you can check the current processing times through the USCIS website.

Hi! I need help for I-140 as below

ND 07/09/2003 NSC concurrent

National Customer Service: It will take 1-2 Month to get approve the case


Online Status: Received on 07/09/2003 taking 150-180 days so on//////////

Immigration Information officer: Talked to IIO on 03/29 & 03/30/2004 to differnt Officers sais case was approved on 10/28/2003

Talked to attorney they didn't received any approval Notice yet 7 said not possible so soon?My friend also get approved in 2.5 month

Again call to Immigration officer : Said they are not supposed to talk to employee regarding case ask your attorney to write NSc


What to do realy frustrated

First of all, I would suggest that you not take what the National Customer Service says as absolute, nor should you rely on the information on the receipt notice or the online status because these are generic guidelines and do not and cannot account for each individual case. They are approximations at best and should be treated that way--as approximate timetables.

Now, if the immigration information officer told you the petition was approved, the online case status would have been updated to reflect this as well. If it hasn't been, then it's probably not yet approved. If you are working with an attorney and the attorney has a copy of the attorney representative form on file with the USCIS, then the petition, once approved, will be sent to the attorney so he/she will know when that happens. If you think that the Immigration Information officers were correct, call again and get their name and inquire as to why you have not yet received the approval notice if the case was approved 4.5 months ago.

Although it is true that some petitions are pulled out of turn and processed quicker than others, that is not the rule but an exception to the rule. THose people should consider themselves lucky, but it is not a precedent for others in the queue. ALso, some Service Centers process petitions on different timetables, so make sure that your friend's was processed by the same service center. And finally, each petition is adjudicated on its own merits so what happened to your friend or anyone else you may know is completely irrelevant to your situation, since your application is reviewed on its own.

if you are gettting contradictory information from different sources, ask your attorney to follow up with the service center on your behalf. after all, that is what they are getting paid for by you or by the company--to represent you in this matter.
 
yes, as my profile indicates, i am an immigration attorney. i am licensed in three jurisdictions (arizona, indiana and ohio) and i have been practicing corporate business immigration law for the past 6+ years.
 
Thanks a lot. I wasn't trying to offend you in anyway. Actually I am in a typical I-140 RFE situation and looking for someone to consult with.

I received a RFE from USCIS for my case. They have asked 11 things...I am not too sure what will happen to my case... but if you can share something from your experiences.\

EB2-CP-July 16 B.E Comp Sc. 7.5 yrs of comp industry experience.

1. Confirm whether the benificiary will apply for his visa abrad or adjust the status within US.

2. Documentation for ownership of the firm.

3. Copy of petitioning firm 2003 Fedral Income tax.

4. Copy of benificiary W2 wage earning statements for 2000,2001,2002 and 2003.
I am okay on this because I have 60K for 2000, 90K on 2001, 95K on 2003 and 69.5 on 2003.

5. Copies of petitioner's most recent "Employers Quaterly Federal Tax Form" (Form 94) and State Unemployement Compensation Report Form. Also submit the similar reports for the first quater calendar year 2003. These documents must be accompanied by the quaterly wage and witholding suppliment which identifies all employees by name and social security number.

6. Copy of petitioning firm's annual balance sheets through December 31,2002 and December 31 2003. The balance sheets provided must identify firm's net income.

7. Copy of petitioning firm's monthly balance sheets through Feb 28,2004.

8. Copy of benificiary's most recent pay voucher. Specify beneficiary's gross/net income received YTD.

9. Ability to pat to each and every individual.
COMPANY HAS ONLY 15 employees. FILED FOR 9 of them and received similar RFE for 7/8 people.

2 of them replied on Jan 15th, so far nothing for them too.

We haven't received any 1-140 approval for our company.

10. Documentary evidence that the five years of experience that is identified within Block 14 of the labor certification is progressively responsible experience.
I ATTACHED ALL THE EXPERIENCE LETTERS WITH MY APPLICATION. I DONT KNOW WHAT THEY ARE ASKING AGAIN.

LAWYER IS SUGGESTING TO CHANGE THE CATEGORY FROM EB2 to EB3???????????
11. Evidence that the benificiary possesses five yrs of progressively responsible experience within the computer industry.
---SAME --- HOW DO YOU PROVE THAT ITS A PROGRESSIVELY RESPONSIBLE EXPERIENCE.
 
i am not offended at all. since i have nothing to hide, i do not mind telling you that i am a practicing immigration attorney.

as for your questions, i cannot really give you any specific advice since i do not know anything about your qualifications other than what you have noted, anything about your petitioning company employer--its business, its finances, its stability, the position and how it was presented in the labor certification or the I-140 and what type of supporting documentation was submitted as part of the I-140 packet.

it sounds like you already have an attorney working on this matter, so it seems that he/she is much more familiar with the situation than i am. i would be happy to give you more specific suggestions or consult, but i need more information. if you would like to contact me directly, you can do so in private. i can tell you that this looks like a pretty substantial RFE and if not addressed adequately, it may mean a denial of the i-140. how much longer do you have to respond to the RFE?

NSC vs other centers

Curious to know what the difference is between the NSC and VSC for e.g.? Is the VSC a part of the NSC?
 
No, VSC is not part of NSC. VSC is the Vermont Service Center and has jurisdiction over most of the eastern seaboard states. NSC is the Nebraska Service Center, with jurisdiction over most of the midwestern states. Both are part of the USCIS, as are CSC (California Service Center) and TSC (Texas Service Center) but all have different processing times for the same types of applications since that has to do with how many petitions and how many personnel members each center has to process. The processing times can be found through the USCIS website.
