Hi! I have looked at the tracker for RFE ad have come to the conclusion that it will take 1 - 2 months, am I right in thinking this?

I think that I will be denied , due to the wrong Company name on the Certificate of Labour. The appeal will take two or more years as I understand it, this is too long as it has already been 4 years. My prospective Employer has held the job open for me all this time. Is there are quicker way that I can get into the USA?

Sure, if you are eligible for an EB-1, or an NIW, or married to a US Citizen. There are lots of quicker ways but probably the easiest way would be to adequately explain to INS why the wrong company name is on the LC and why the new company is eligible to use it anyway. Maybe that way the I-140 will not be denied. You need to know this anyway since you will be wasting 2 years on an appeal if the denial is in fact correct. If you are not eligible to use the LC, you are wasting time now even filing the I-140.

My attorney (hopefully) has expressed to the INS the reasons for the wrong name, hoping that the INS will except the reasons.

The reasons why it was the wrong name is that the LC is in the trading name of the Company and not the Tax name of the Company, but all tax numbers corresponding to all document submitted to the INS are the same.
