I140 Rfe

Hello Friends

I received a RFE query ( asking for my 2003 & 2004 W2 and latest 2 Months PayStubs) for my I140 on April 28,2005 and replied to it on June 2,005.

My 2003 W2 is less whereas 2004 W2 is good and my latest salary payslips are in according with the salary mentioned in Labor approval.I think my category is EB3.

I have an approved EAD and AP (Valid till Dec 2005) and currently I am outside of USA & planning to enter US on AP,my question is that in case my I-140 gets denied can I enter US on AP.My H1B is approved till March 2008 but Visa is not stamped on Passport.

So is my AP Valid even if my I140 gets denied,Please reply to me I am concerned about this ASAP.
 
Hold your breath , your I-140 will be approved soon. Don't worry about AP now.
