My employer recently received an I140 RFE(Request for Evidence) to prove financial ability. My employer is ready with all the necessary documents to submit.
I am wondering, in case there occurs a problem with my I140, do I have the option to withdraw this application? and If so, Can I use the labor certification and proceed with my GC process through different employer?

Suggestions and help are welcome asap..

Thanks!!!!

You can withdraw your 140 application when a RFE comes. But the underlying approved LC is not portable between employers. If you join a new employer you need to start a new Labor or if your new employer has an approved LC which matches your skills, you can use it to file 140 and 485.
