I140 RFE ISSUED- PROFF OF EXPERIENCE, ABILITY TO PAY Got an RFE from NSC regarding:
1. Proof of required two years experience before the labor certification was filed.
2. Ability to pay for the company
My lawyer says we can not use the experience I had with my current employer BEFORE the labor certification was filed, although the RFE does not say anything like that; the lawyer thinks its always a trap....
I worked for this current employer for over two years before they were willing to file the labor certification. My lawyer said that the only way we could show the two years of my experience with the current employer was ONLY if we could prove that my job description prior to the labor certification was atleast 50% different.
Anyone in the same boat, please help.
