I would appreciate clarifications on these points:
My husband's labor petition was approved in Mar 2005 for the job title of "Software Engineer"
GC is sponsored for me also by my company with an earlier priority date. So 485 has been applied for me and my husband. So we decided to wait till the end of this year for applying for I140 through his company. Would the time gap between labor certification and application of 140 petition trigger any issues?
Also my husband's H1 7th year extension was approved based on pending labor petitiom. Now that labor petition has been approved can he still file for 8th year extension based on that. The attorney is saying that for 8th year extension, I 140 must be applied. Is that true?
My husband's job title changed to "Senior Software Engineer". His duties have not at all. Would that be a problem to apply for I140 petition?
