I140 pending EAD more than 90 days

I have filed my I-140 and 485 on Sep 26 2003. Last week, They asked me to submit previous experience letter. I need my EAD. My file is submitted more than 90 days back. Will this I-140 query effect my EAD processing?? Please help.
 
I guess it will delay your EAD. As per earlier postings here, folks had hold on EAD if a RFE is issued for I-140 until RFE is replied.

Your best bet is replying RFE at the earliest. That way you could possibly get both EAD and I-140 approval.

If the RFE was for I-140 You should be able to collect IEAD from your local office. Just check it. Just Do not tell them you had RFE on I-140 unless they ask.
 
Does any one have experience of getting EAD and AP from local office in the Dallas TX area?

I have a few question to ask them before I apply for my interim EAD .

Any help would be appreciated ,

Hi all,
My ND is Aug 20, 2003 for 140, 485, EAD and AP. I haven't received the EAD and AP till now because of an RFE on 140. Even though I have replied to my 140 and my 140 has been approved on Dec 30th, I haven't received any news about my EAD and AP. Did anyone else went through the same experience? I am planning to go to India in Feb. If I don't get my AP aproved by then, can I apply for interim AP?

I-765 filed online 09/10/03 (Basis I485 filed on Sep'02 and approved I-140 on Dec'02) Went to BOSTON USCIS office on Dec 9th, 2003 (91st day)Current EAD expires on 12/10/03 (working on EAD)

Timeline:
6:00AM :
Arrived and found there are around 20 people ahead of me.

7:00am: Entered building and told that I am there are EAD extension. I was asked for I-765 notice (it is exactly 91st day after filing)and asked me to fill a new I-765 form and got a "E" number.

9:00am: Went to Counter, told that I have applied for I765 and it is over 90 days. Officer asked for I765 and checked the status. Asked for photo Id (either driver license or passport), copy of I-765, current EAD.
Officer stapled current EAD on new I-765 form and told me that I will be given Interim EAD for 8 months with fee waived. Officer asked me to go to room for EAD ISSUANCE. Got EAD in 1/2 hr. Officer is very polite and supportive. I was never nervous and asked questions to the point and answered questions to the point.(few interesting questions popped up, I filed online and Officer told me that my I-765 is at Chicago and it surprised both of us. At that time, I told officer that I actually applied online and may be national service center is routing apps to other service center, I specifically asked officer what if I don't get my filed EAD with in 8 months(Aug 08,2004), then answer given was to reapply before 90 days of
before expiry of newly issued EAD).

10:00am: Out of office with EAD.

Few observations from my experience. Online is slower than sending to Service center. In my case Online app went to Missouri Service Center(NBC) and currently they are processing Apr 28,2003, whereas Vermont Service Center is already processing Sep 11, 2003.

did you not submitted your exp letters at the time of applying for i-140 or they asked for original exp letters ?

I also applied i-140/485 on sep-26 2003,

I thought, lawyer submitted all my experience letters. But, he didn't submit. Also, they asked me to do education evaluation. I am submitting my education evaluation and exp letter this week. I've already passed 90 days. I need EAD for my wife. I planning to attend local office (Newark) this week for interim EAD.

Following documents are enough to get interim EAD?

* I-765 copy
* Original Passport
* Printed status from BCIS website. (It says your application was recieved on Sep 26 th......)
* My original reciepts are with my Lawyer. I've requested my lawyer to fax the reciepts.

CIS has guidelines to submit always Copies. If you are worried you can send notarized documents. But never send originals. They will not be returned

Hi,New to this site.
My employer use the subtitute lc which already approved for me,and my attorney submitted the i485/i140/i765 for me o 11/04/03.Receive the receipt notice on december.

However the attorney refuse to give me another 2 receipt,I guess it was for i765 and for my wife and minor child.
My attorney also say the law change.i will only get the EAD upon approval of my i140.
Is it true?l
 
on Jan8th, I went to Newark INS office to get interim EAD. They rejected because, my case is on hold. I have RFE on I140. I am sending docs for I140 RFE tomorrow. Is because I have RFE on I140, my case is on hold or ???? I don't know what to do..
