I140 Not Approved - I485 RFE issued

Friends,

I filed my case concurretly on 04/03/2003 and got an RFE on my I140 (to change category from EB2 to EB3) in Apr 04 and the response was received by USCIS on June 9th 2004. There is no update since then. But today when I checked the status online for I140 there is no change and for 485 it says the following :

On August 21, 2004, we responded to your request for more information concerning your case. If you have not received our response within 30 days from this date, please call customer service at 1-800-375-5283.

I dont know what's happening...I was wanting my 140 to be approved but i think I am only getting the RFEs no approvals.

I am in same position as you....except..

I got rfe on Both I-140 (04-MAy-04) and I-485 (06-Jun-04) .
I-140 Rfe was replied on 01-Jul-04, but I did not get my I-485 Rfe , So my lawyer requested duplicate copy on 07/14/04. After 2 weeks Lawyer personally went to vermount office on 07/30/04
(becs her office s few miles away from vermount office) again asked for duplicate copy..Officer kept her waiting and did investigation and told her tht they have all information what they needed for I-485 through I-140. So they do not need any addional information...

There is no change in message in I-485 , still it say
On June 7, 2004, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice, please call the National Customer Service Center at (800) 375-5283.

I am pissed off...

Well you need to read the message again. What it says is that USCIS responded to your query i.e. you raised some query and they responded to it. I am not sure what query you would have raised but I got the same message when my wife's ead was sent back to USCIS as undelivered and I requested to resend the EAD for my wife by going to a local center. I got my Wife's EAD (again when that happened the USCIS message changed to something like, we have mailed you the blah blah blah) and then yesterday the message changed to exactly what it is for you.
So dont panic.
 
SorryTemplabor...I did not read the message correctly earlier..now I get it. I remember my attorney initiating a status inquiry for I140 (because it was pending for more than 485 days) but I dont know why they have updated the message for my I485? My I140 message is still the same (received response for the RFE blah..blah)

Was it after replying I140 Rfe or before ?

- According to my attorney he intiated on Aug 6th

- After replying (actually 2 months after replying)

but the thing is I dont know what the attorney did..as I see the status updated for 485 instead of 140..its all a mess
