I140 Issue: Financial Status Of Company

Hi,
My lawyer had Applied my I140/I485 Concurrently Recently. My Company had provided the Letter of Support to lawyer saying that it is going to pay my wages. Also same document is having the Gross Income and Net Income details where New Income is having negetive figures. Lawyer had entered the same figure in my 140 application (gross and net income of the company). He submitted my W2 for the last 3 years (i was paid for the last 3 years) along with the 140 Application and Letter of Support. My salary is less then what is specified in my LC.
When I asked my lawyer about this discripency( Company negetive net income and my income(w2) less then the specified in LC), he told that everything will be fine since they submitted by my W2.

Is that true that I will be Fine with what my lawyer had submitted???? :confused: :confused: :mad:

There was a memo, which I forget the name of, which basically says that if no other documentation can be provided to support the financial state of the company, then W-2's are all that is required. My lawyer seems to think that CSC has been tending more towards this policy lately.

Are you talking about my W2's or the Company W2's that are required if no other documentation can be provided to support the financial state of the company. My Lawyar had submitted my W2's for the last 3 years and the company tax return's for previous 2 years but not this year as they didn't file this year. I am filing from Texas Service center. Also The income in my W2 is less then the income specified in labor certificate. Is that OK???

Your attorney will need to go over all the material and explain the situation to USCIS and argue why they have the ability to pay. Corporations take tax deductions for depreciation and expenses so just because a corporation shows a negative net income does not necessarily mean the corporation lacks ability to pay. However, USCIS is unlikely to understand this unless it is clearly explained to them and this explanation is entirely fact specific.
