After 10 months, i received I-797 in blue color from INS about my I140 EB1 petition. In the I-797, they said the evidence submitted to INS was not enough to put me as EB1. They asked me submit more evidence, such as more reference letters, comments about my research from news, journal or magazine. They asked me submit these additional evidence with the original I140 documents i already submited to them.

It seems this is not a RFE, what is this? any chance to get approval after i submit the additional evidence?

any comments are welcome. please help.

waitfor140,

Sorry to hear about your RFE, for that is exactly what it is. I think your best chance for success is to submit as much of the additional material as possible. Get people you know to write glowing letters about you, in my experience, when you tell them it is for INS people are usually willing to sign any letter. Praise yourself to the sky, call yourself the best in the world in your field.

waitfor140, could you please tell us:

what is your I-140 ND?
is your EAD and AP docs approved?

thanks in advance.

No, I did not file EAD etc because I just began my H1.

Now, I am considering to submit as much document as possible for this RFE. At the same time, I will ask my company to apply Green Card for me. (as outstanding researcher or through LC). I am not sure whether there is any conflicts with (or negative impact on ) the pending I140?

Thanks.
