I140 filed under wrong category -- Urgent

Hi
My labor was processed under EB2 since the job required a masters degree. However, my company lawyer filed the I140 under EB3 by mistake. My Priority date is Aug 2004 and I was getting ready to file for my 485 and that's when the *&%% lawyer realized the mistake.

I did not get a chance to talk to my lawyer directly but HR told me that they are going to refile under premium processing. Would this work and how long would it take to get approval. Any other possibilities??

Please help!!!

I am in similar situation. My labor is in EB2. I-140 approved in EB3. My priority date became current this month and when I was sending documents to lawyer, I noticed I-140 was approved under EB3. Who could have thought of it. I am very pissed. Is there a quick solution out??

My company attorneys refiled under EB2. I am waiting for the approval.
Anu updates on this case? Did you refile??
