March 2005 I140 Approved, I485 RFE

My I485 got RFE on 4/8 asking for 1. 2004 Tax return, W2
2. 3 recent paystubs.
3. Original Employment Letter.

Will this be big issue? Please share your thought and experience. If I reply the RFE next week, how soon I can get the decision? Thanks.

Thanks for your reply cht213. The RFE documents are usual ones other than asking the very latest tax return. I don't know how your attorney missed to send the latest pay stubs and employment letters. In which field are you working!

hi SAI_GIVE_GC2005:
Thanks for the reply. I am a software developer. The RFE is asking for orginal employment letter instead of copies. I don't know why they are asking 2004 tax return, maybe because this is the right time to ask for it. As for the paystubs. I only attached 1, and they are now asking for 3 most recent ones. Thanks.

Hi cht213

They will ask for 3 latest pay stub. May be they want to have the recent tax return. So they ask for the 2004 return. Regarding the original employment letter, your employer has to provide a letter in such a format stating that they will provide the job in future once your Green Card is approved with all your title, etc information. I think you might have sent a copy of your employment letter that issued when you joined the job. If not and you have already sent a copy of the future assurance employment letter then you need to send the original not copy. If you have not sent such a letter than ask your attorney to provide format for that.
Don't worry all documents they required in your case is very normal one.
Best wishes.

hi SAI_GIVE_GC2005:
Thanks for the reply, I have been working for this company starting from 2001 till now. Should I send the original letter when I joined or the letter for future job assurance? Thanks.

INS will require a letter from employer stating that you will be supported by your employer for this job once you get the Green card plus other information like title, etc., It is not the original employment which you received when you joined. Please check with the attorney for the format. if i get any format I will forward to you.

Hi SAI_GIVE_GC2005:
Thanks for the information, I will check with my lawyer and in the meantime, if you have the format about the letter? can you send it to me at cht213@gmail.com? Thanks.
