My husband's I140 under EB1 was denied in January, we applied for a MTR; Today we have heard from USCIS that our case has been sent on to AAO. We understand that that process could very well take 18 months.
I'd like experienced folk here to advise about what we should do next. My husband is here on L1, which expires in Sept 2008. We have so far used 3 years of the allowable L1 period ( I understand that is 7 years), & are filing for an extension. However, a real concern for us is that USCIS could deny the L1 extension for the very reasons the I140 was denied ( not sufficient proof that petitioner is working in a managerial/ supervisory capacity). Is that a valid concern?
What else can we do to better our chances of getting an L extension/ securing a green card? I have heard that we should apply for another I140 under some other category. What other category can EB1 applicants apply under?
