My I140 was deinied becasue of my company's inability to pay. Based on all the responses I have seen here I have prepared an email for my lawyer. Can anyone please read the below and let me know what they think:
I have Re-calculate the preferred wage to prorate it for that particular calendar year (2001) from priority date (July 24, 2001). The re-calculated difference is what I have compared with the net income on the tax return as subsequent years there is no problems at all in my case. Here is my calculation
Prorated Actual Wage paid from Priority Date (July 24, 2001): -- we will submit copies of paystubs for this
Month Wage Paid
July $5000
August $5000
September $5000
October $5000
November $5000
December $5000
Total: $30,000
Prorated Preferred Wage (Per LC) from Priority Date (July 24, 2001):
Month Wage that should have been Paid is
July $1019
August $6320
September $6320
October $6320
November $6320
December $6320
Would a write up in this regard be enough to open up the case again? and get an approval or shoudl we file for another I140/485 and also a new labor altoghether
