My I140 application got denied on the grounds that the labour certification was invalid. I am using a pre approved labour. The labour documents were signed by someone who was not the owner(but a member) of the company at the time of filing the labour. Now that person is the owner. CIS says as per meriam webster dictonary LLC is seperate entity from its members and only owners should sign documents like labor cert.
The denial notice finally states
<The Director forwards this matter for review to the Associate Commissioner for Examinations.>
My attorney thinks this is an invalid and is planning to appeal. He says CIS should not go by definition in meriam webster.
What are the chances of this appeal getting approved. Also in genral what is the success rate on appeal process ?? Also what is the genral time line for the appeal process ??
