I140 denied H1b renewal approved

Hello, I gt a denial end of August for my I140 and I485. my lawyers filed an H1b extention which got approved with a comment that since my initial h1b expired December last year that I might be in inviolation of my immigration status. I go back to Germany next week to get the H1b stamped into m passport at the conuslate. Do I have to have concerns regaring the gap time between the denial and the 6 weeks between that as I overstayed in the US? I had an AD card and as I traveled in March an I94 stamp wich epxires next year. I heard about 180 days but I am not sure how much it could affect the appointment at the embassy. Thanks
