My H1 (6 yrs) expires in 4 weeks and filed an extension in normal processing. My I140 got denied and filed for an appeal and it is pending since 2 weeks. We filed H1 extension using the appeal notice. What are the chances of H1 approval in this scenario?
I learned from my employer that they have received few RFE’s for other extensions for the people who are on bench. I am continuously on payroll. Even my current H1 (which was approved in 2007) also had a RFE and we submitted the vendor-to-client links etc. and I am still working with the same project.
Do I eligible to get 7th year extension based on a pending I140 appeal? I also have EAD (but I140 denied – Appeal is pending) Can I use it if H1 extension fails? Should I have a backup plan by filing H1 transfer with other company? Please advice!
