I140 Denial at tsc

Hi,
I need help my I140 based as manager/executive was denied at TSC. The main reason was that my company only had 5 employee and my job duties did not qualitfy as a manager.I have 30 day to appeal and my lawyer does not think it is wise to appeal. Can i redo a I140 on the same company again? What options do i have...

how did you filed your labor thru perm or back log centers.
