Folks,
Can anyone let me know as how can I get a copy of I140 approval notice from INS other than from my employer. Can we call BCIS and request for a photocopy of approved I140?

Use FOIA.
 
Hi Folks,
I just hung up talking to an INS officer and he told me that we CANNOT use FOIA to get a approval notice copy, as FOIA is used for others to get information about your case.

All we need to do is Fill in I824 form to get a copy of any approval notice from INS and for which they charge $195 dollars(Too much to get a copy)..

Just wanted to share this information to all who might be looking for..

Don't tell you need approval notice. Tell them that you need case details about Want ... :) OK? In the form fill details of 140 and underlying LC petition. You will get the stuff you need.

Search FOIA on this portal and also check:

But the officer was talking clearly and also told me if I am clear in what he was saying. He doesnt even wait for me to ask him another question and was busy to keep the phone down. I kept asking him a couple of questions and made him busy.

One more.. If we want to renew the EAD, is it a brand new appln and it doesn depend on the current EAD card? As the same guy told me that whatever EAD that you have even though its approved before, doesnt mean to say that you would get the 2nd one(EAD).

I told him that I got an interim EAD but not updated on the website. He said that I dont need to worry about it as long as I have the original EAD card. Do I need to send INS a copy of my old EAD card when I apply for the 2nd EAD? I dont have any approval notice from INS for the EAD card though, as I got it from local INS office..

For yoor info and the INS oficer guys info, I did use FOIA to request a COPY of my I-140 and underlying labor. Apart from filling in my information where requested, I wrote in Question 5 of the form (G-639, Freedom of Information Act/Privacy Act Request) "I request a complete copy of my I-140 petetion and underlying labor certification and approval notices".

In about 30-35 days I received 20 pages containing the COPIES of I-140 receipt, I-140 approval, Form ETA 750, Labor Approval, I-140 RFE letter and attornies response to the RFE. It did not include any documents about my company like their audited financila results etc.

If you need any help or have more questions on this, feel free to ask.

You should get the original EAD form along with the EAD Card from CIS. Interm EAD's are given for only 8 months . after that you will get the EAD from CIS for the last 4 months.

Ex: if you go for interm EAD in Jan 1 04 you will be given interm EAD till SEP 04 and then you will get EAD form with EAD card attached( just like credit card) from CIS from SEp2 till Dec 31 st 04 .

Atleast this is what happened in my case.

When you apply for the renewal you need to send the top portion of the EAD form along with the rest of the Documents.

Did not I tell you that:

Perhaps officer was boozing/smoking pot when you called him/her.

File FOIA now - and then after 2 months post your experience. :)

In 6 subdivision: what are the details to be filled up??

Alien Registration #? is it the visa number on our passport??
Petition or Claim Receipt number: I140 receipt notice number or something else?
Name of Naturalization Certifications?? Certificate #? Naturalization Date??
Address of Naturalization?? Court and Location???

Do I need to sign before a Notary and send it to INS???

Can u travel abroad with an Interim EAD / Advance Parole?

Check notice of 140/485/EAD/AP - any of these. You will find A# on the form.
If you have 140 case number put that in Petition or Claim Receipt number.

Don't worry about answer to rest of your questions - you do not need to fill it.
 
Thanks JK. It looks like I need to get it notarized now, before an notary as there is a column where he needs to sign and seal..
