I140/ Concurrent Filing Question

Hi,

I have filed for my I140 with counseller processing option (July 03). Now since I see the time line for clearing I140 cases is about 485 days, I want to change my approach and file my I485. However my lawyer says that once the option is exercised in the I140 application, it cannot be changed. Is there anyone who has sucessfully done this- basically filing I485 after submitting I140 opting for Counseller processing ????

That is possible!

There is no new regulation that prevents you from filing 485 after opting for CP in the I-140 petition. The attorney should submit a letter about this change, while filing the 485.
My attorney did this,but my case is pending.... However, 2 other guys who did this switch got their approvals. You can confirm with murthy on the Monday chats.
