Am I missing something here ? Your I-140 was approved in June 2003. You had a 485 pending for over 6 months, and still you filed another 140 & 485 . Why did you not use AC21 ?

reply

To BCIS,
RFE was asking for employment letter to make sure I am still employed by my GC sponsor. I did not file AC21 until I got the RFE.

To Sertra2002,
I switched employer on December 10, 2002. Sorry about this. So it is less than 180days.

Yes, I applied AC21

Yes, I applied AC21.
I didnot mention exact date of changing employer.

I am thinking should I send the new I140 approval notice and append it to my I485 after using AC21.

How about if I do it, will they approve it based on AC21 or new I140?

Thanks

keep quite some time, there is more chances to won the case if you not specify the dates. As per the AC21 Memo you are in the track to utilize the benefites on portabilitty.

As per law it may not possiable to link with other Immigration Visa to prior filed Adjustment status application.
